SMMDS - Tickets

By using any SMMDS event ticket, the Holder agrees to the following terms and conditions and such other terms as outlined on SMMDS’s website, which may be updated from time to time without notice, (the “Terms”). The Holder is solely responsible for reading and understanding the Terms before using event ticket. 

The Holder acknowledges and agrees that each individual wishing to attend the event must hold and present their own individual ticket upon entry. Unlawful sale or attempted sale of this ticket is prohibited. Tickets obtained from unauthorized sources may be invalid, lost, stolen or counterfeit and if so, are void.

SMMDS reserves the right to terminate the license granted by event ticket by tendering to the Holder the purchase price printed on event ticket. Further, SMMDS reserves the tight, without refund of any portion of the purchase price, to revoke the license granted by event ticket and refuse admission to or eject from the event, the Holder if such person (a) violates the Terms, (b) is in possession of any item or object that SMMDS or its agents consider potentially dangerous, hazardous, inappropriate, and/or injurious to other patrons, and any prohibited items may be confiscated; (c) appears to be or is intoxicated; (d) engages in conduct deemed by any of SMMDS or its agents to be improper, disorderly, unbecoming, abusive, illegal or objectionable, or might otherwise interfere with the event or the reasonable enjoyment of others; (e) uses vulgar or abusive language; or (f) poses a risk to the health or safety of others.

The Holder acknowledges and consents to reasonable examinations and searches as deemed necessary by law, the facility, organizers and SMMDS or its agents to ensure compliance.

Recordings of the event listed on the front of event tickets are prohibited without express written authorization of SMMDS.

No refunds. No exchanges. Event ticket bears no cash value. Applicable taxes are included.

Ticket may not be sold in excess of the face value of the ticket without express written consent of the issuer

Complimentary tickets are not exchangeable or redeemable for any benefit offered to tickets with a dollar value

Tickets may not be used for advertising, promotion or other trade purposes without express written consent of the issuers

Tickets are not transferable between patrons while the event is ongoing

Event date and time are subject to change 

If the event for which this ticket is issued is rescheduled or cancelled, the holder shall not be entitled to a refund except as otherwise required by law

The holder agrees not to transmit or aid in transmitting any description, account, picture, or reproduction of the event, performance or exhibition for which this ticket is issued.

The holder acknowledges that the event may be broadcast or otherwise publicized and grants permission for holder’s image or likeness to be used in any live or recorded transmission of such event, performance or exhibition

Holder must produce valid ticket when requested at any time prior, during or after the event on the front of the ticket at the request of facility, SMMDS, sponsors, ticket producers or issuers or their affiliates.

Assumption of Risk of Personal injury, illness and/or property damage:

“The Holder recognizes that attendance of the Holder at the event is voluntary and may result in personal injury (including death), illness and/or property damage and agrees to abide by all Terms and applicable policies and laws. By using this ticket or by attending, observing or participating in the event, the Holder acknowledges and assumed all risks and dangers associated with: attending, observing or participating in the event, in each case, whether any such risk or danger occurs prior to, during or subsequent thereto.”

General Release of liability and covenant:

“The Holder hereby waives, releases, discharges and holds harmless SMMDS, the facility, the organizers and their respective agents, employees, volunteers, officers and representatives with respect to any claim, liability or demand of whatever kind or nature, either in law or in equity, that may arise in connection with or relate in any way to (a) the use of this ticket, (b) their presence at the facility where the event takes place or participation in the event or any related activities”

Indemnity 

“the Holder will indemnify, defend and hold harmless SMMDS, the facility, the organizers and their respective agents, employees, volunteers, officers and representatives from and against any and all demands, suits, claims, costs, expenses and liability arising out of, incidental to, or related in any way to (a) the use of the event ticket, (b) their presence at the facility where the event takes place or participation in the event or any related activities, (c) the Holder’s breach of any of the Terms, and/or (d) the Holder’s acts or omissions.”
